Werkadoo, Inc. (hereafter referred to as “Werkadoo” or “we”, “us” or “our”) facilitates the posting of professional service contract work (“Jobs”) on behalf of “Business(es)” on its website at werkadoo.com or on its partner websites (collectively the “Site”) and the bidding and performance of those Jobs by remote professionals and project managers (“Werkers”), who may work alone or as a member of a team (the “Service”). Our primary goals in collecting information are to provide and improve the Site, to administer your Membership, to better facilitate transactions, and to improve Site navigation and the Service. Werkadoo values the privacy of its users, Members, and others who visit and use the Service (collectively or individually, “You” or “Users”).

 

By using the Service, you expressly consent to the information handling practices described in this Privacy Policy.

 

This Privacy Policy is incorporated into and is subject to the Terms of Service (the “ToS”). Your use of the Service and any personal information you provide through the Service are subject at all time to this Privacy Policy and the ToS. All capitalized terms not defined herein, are defined and have the same meaning as in the ToS.

 

This Privacy Policy may be revised periodically without further notice to you and this will be reflected by a "last modified" date above. Please revisit this page to stay aware of any changes. In general, we only use your personal information in the manner described in the Privacy Policy in effect when we received that personal information. Your continued use of the Service constitutes your agreement to this Privacy Policy and any future revisions.

 

For revisions to this Privacy Policy that may be materially less restrictive on our use or disclosure of personal information you have provided to us, we will make reasonable efforts to notify you and obtain your consent before implementing revisions with respect to such information.

 

1. HOW WE COLLECT INFORMATION

1.1 Registration. If you register as either a Werker or as a Business, we will ask you for information that can be used to personally identify you and to contact you (“Personal Information”). We use your Personal Information mainly to provide the Service and administer your inquiries.

To register as a Business we require that you provide us your desired username, password, email address, and first and last name. To register as a Werker we additionally ask you to provide us with the category of the services you intend to provide and a list of skills that you possess within that category. We may, in the future, include other optional requests for information from you, to help us to tailor the site for you and deliver personalized information to you.

1.2 Multi-User Accounts. We do not encourage Users to set up multi-user accounts. However, if you share your account information with other people in your business or your work community, the information you provide to the Site may be accessible to, and may be modified by, any of the other people you have granted access to the account.

1.3 Profile. To further facilitate the Service we allow users to add information to their Profiles in the “Dashboard” section of the Site.

In general the information that Users may post includes contact information, description of services, work experience, education, professional licenses and certifications, list of professional references, links to personal profiles on other third party websites, description of past work performed, and tags that can be used in searching for the User.

Users are given the option to choose what information is made available publicly and which information is to be kept private. For example, a User can decide if their profile will publicly display their complete address, or just their city and state, or country.

We will not have any obligation under this Privacy Policy with respect to information you have made public in your Profile or information you voluntarily provide to other Users via the Site. As improvements are made to the Site we reserve the right to add other optional and mandatory information requests.

1.4 MyWerkspace, TeamWerkspace, Forums, Reviews, etc. Many areas of the Site are intended to facilitate communication and the exchange of information between Users. Werkadoo reserves the right to monitor communications in these spaces in order to verify compliance with our Terms of Service, international, federal or state laws and/or our other stated policies and to collect information as is reasonably necessary for Werkadoo to maintain the Site and otherwise conduct its business.

1.5 Automatically Gathered Information. When you visit the Site, whether as a registered User or a non-registered visitor just browsing, our servers automatically record information that your browser sends whenever you visit a website (“Log Data”). This Log Data may include information such as your computer's Internet Protocol (“IP”) address, browser type or the webpage you were visiting before you came to our Site, pages of our Site that you visit, the time spent on those pages, information you search for on our Site, access times and dates, and other statistics. We use this information to monitor and analyze use of the Site and the Service and for the Site's technical administration, to increase our Site's functionality and user-friendliness, and to better tailor it to our visitors' needs. We also use this information to verify that visitors to the Site meet the criteria required to process their requests. We do not treat Log Data as Personal Information or use it in association with other Personal Information, though we may aggregate, analyze and evaluate such information. We will not use IP addresses or other system information to identify a User unless we determine, in our sole discretion, that it is necessary to enforce compliance without various policies to protect our service, site, customers and others. Finally, we may collect additional information from or about you in other ways not specifically described here.

1.6 Cookies. Like many websites, we use “cookies” to collect information. A cookie is a small data file that we transfer to your computer's hard disk for record-keeping purposes. We use cookies for two purposes. First, we utilize persistent cookies to save your registration ID and login password for future logins to the Site. Second, we utilize session ID cookies to enable certain features of the Site, to better understand how you interact with the Site and to monitor aggregate usage by Users and visitors as well as web traffic routing on the Site. Unlike persistent cookies, session cookies are deleted from your computer when you log off from the Site and Service and then close your browser. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Site or all functionality of the Service.

1.7 Payment System. We offer a payment system that allows Businesses and Werkers to pay with a credit card or by bank transfer (the “Payment System”). If you make use of this service, we will collect your credit card number and/or other entered financial institution information and will use that information to bill you any fees and/or to perform the billing operation on behalf of the Werker, including but not limited to the use and disclosure of such credit card number and information to third parties as necessary to complete such billing operation.

1.8 Online Surveys and Contests. Occasionally, we conduct User surveys to collect information about our Users’ preferences. These surveys are optional and if you choose to respond, your responses will be kept anonymous. Similarly, we may offer contests to qualifying Users in which we ask for contact and demographic information such as name, email address and mailing address. None of this information is shared with third parties, except in summary form, if at all. The demographic information that we collect in the registration process and through surveys is used to help us improve our Services to meet the needs and preferences of our Users. This may include targeting advertising to you about our Services. Information we gather through a contest may also be disclosed to third parties as necessary for prize fulfillment and other aspects of any contest or similar offering.

1.9 Email Referral and Invite Features. We offer Users the ability to invite other professionals and businesses to try the service and to share public postings with non-users through email messages sent by us on behalf of you. If you choose to use this feature, be assured that we only uses these email addresses on a one-time basis to send the requested invite or posting and we use your email address to copy you on the message or to send on your behalf.

1.10 Comments Submitted to Us by Users. We value your input and encourage you to help us expand and make improvements to the Site by providing us with any thoughts or comments you might have regarding the site. When sending us comments we may receive your email address or User name. This information is optional. If you provide this information, we will only use it to acknowledge or respond to your comments. Submitting comments via an email will not cause you to receive any secondary or promotional material, unless specifically requested by you. In certain circumstances, we may ask for your permission to post your comments in marketing or promotional materials.

 

2. HOW WE USE YOUR INFORMATION

2.1 Personal Information. We use Personally Identifiable Information for our own internal purposes including contacting you via email to inform you about updates to the Site and Service and of transactions you have initiated on the Site. We reserve the right to disclose your information as required by law. We do not rent or sell our Users' Personally Identifiable Information to third parties. We use Personal Information to communicate with you via email.

2.2 Non-Personal Information. We reserve the right to use the general data we collect from Users' use of the system, including all statistical information, that is not personally identifiable information. You acknowledge that such data belongs to Werkadoo and that we shall have the right to use such data as we desire in our sole discretion.

2.3 Advertising. We do not share your personally identifiable information with other organizations for their marketing or promotional uses without your prior express consent. Certain personally identifiable information that you chose to display, such as your name, address, profile picture, and/or biography is made public when published to the Service. Personally identifiable information that you do not chose to make publicly available by posting to the Service is not shared with other organizations for their marketing or promotional uses without your prior express consent.

2.4 Co-Branded Services. We may enter into co-branding relationships with third-party web sites and companies to provide products and services to our Users. Werkadoo may share your Personally Identifiable Information, including User ID and password, with certain co-branded third-party service or product Providers as required to provide a specific product or service. However, these third-party partners may not use this Personally Identifiable Information for any reason other than to provide the service or product that the User has explicitly signed up for. While it is Werkadoo's policy not to share anything other than summarized or aggregated data with the partner, any Personally Identifiable Information you provide may also be received by the co-branded site and could be stored and used by the co-branded service or product Provider according to their privacy policy. Please take the time to review these third-party privacy policies.

2.5 Service Providers and Contractors. We may employ third party companies, contractors and individuals to better facilitate our Service, to provide the Service on our behalf, to perform Site-related services (e.g., without limitation, maintenance services, database management, web analytics and improvement of the Site's features) or to assist us in analyzing how our Site and Service are used. These third parties may have access to your Personal Information; if they do, this access is only so that they may perform these tasks on our behalf and they are obligated not to disclose or use it for any other purpose. We may also use third party services to aggregate information about you from third party sites. We may also provide Personal Information to our business partners or other trusted entities for the purpose of providing you with information on goods or services we believe will be of interest to you. You can, at any time, opt out of receiving such communications.

2.6 Other Members. We may share your contact information with other Members with which you have entered into a Job Contract.

2.7 Legal Disclosures. We may disclose User information if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright law) or respond to a court order, judicial or other government subpoena, or warrant in the manner required by the requesting entity.

We also reserves the right to disclose User information that we believe, in good faith, is appropriate or necessary: to take precautions against liability; to protect Werkadoo from fraudulent, abusive, or unlawful uses; to investigate and defend ourselves against third-party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Service; or to protect the rights, property, or personal safety of Werkadoo, our Users, or others.

2.8 Partners and Affiliates. We may disclose User information to affiliated companies or other businesses or persons to: provide web site hosting, maintenance, and security services; fulfill orders; conduct data analysis and create reports; offer certain functionality; and assist us in improving the Service and creating new services or features. We require that these parties process such information in compliance with this Privacy Policy, we authorize only a limited use of such information, and we require these parties to use reasonable confidentiality measures.

2.9 In the Event of a Merger or a Sale. In the event that Werkadoo is acquired by or merged with a third-party entity, we reserve the right, in any of these circumstances, to transfer or assign the information that we have collected from Users as part of that merger, acquisition, sale, or other change of control without prior notice or consent of Users.

 

3. OUR COMMITMENT TO CHILDREN’S PRIVACY

The Werkadoo Site and Service is not for children under the age of 18. Protecting the privacy and safety of young children is especially important.

IF YOU ARE UNDER 13 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE SERVICE AT ANY TIME OR IN ANY MANNER.

We do not knowingly collect or maintain personally identifiable information from persons under 13 years-of-age. If we learns that personally-identifiable information of persons less than 13-years-of-age has been collected on or through the Service, then we will take the appropriate steps to delete this information. If you are the parent or legal guardian of a child under 13 who has become Member, then please contact us at privacy@Werkadoo.com to have that child’s account terminated and information deleted.

 

4. OUR COMMITMENT TO DATA SECURITY

We use commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to Werkadoo, and you do so at your own risk. Once we receive your transmission of information, we makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. If we learn of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. We may post a notice on the Service if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive a free written notice of a security breach you should notify us at privacy@Werkadoo.com.

 

5. INTERNATIONAL VISITORS

For Users visiting the Service from the European Economic Area or other non-U.S. territories, please note that any data you enter into the Service will be transferred outside the European Economic Area or such other non-U.S. territory for use by Werkadoo and its affiliates for any of the purposes described herein. In addition, because we operates globally, we may make information we gather available to worldwide business units and affiliates. By providing any data on the Service, you hereby expressly consent to such transfers of your data to the United States or other countries.

 

6. LINKS TO OTHER SITES

We are not responsible for the privacy practices or the content of any other websites to which the Site links or to which link to the Site. By clicking on a link, logo or other item, or using certain services available on the Site, including the online communication services, please note that you may no longer be on the Werkadoo Site. To check what Internet location you are on, note the URL at the top and/or bottom of your browser. We encourage you to read the posted privacy statement of that website whenever interacting with any website.

 

7. CORRECTING AND UPDATING YOUR INFORMATION AND OPTING OUT

This Site lets you correct and update your information, as well as to choose what information is public and what is private in the Dashboard and by contacting Customer Support. Additionally, you can opt out of certain communications from the Dashboard or by contacting Customer Support.

 

8. TERMINATING YOUR MEMBERSHIP

We save your Personal Information until your membership with us is terminated and you unsubscribe to email notifications. To terminate your membership, contact Customer Support. If you terminate your membership, your Personal Information cannot be recovered. You may continue to receive email communications for a short period of time until we have updated all of our databases. After termination of your membership, your Personal Information may remain on our archived database and records. Notwithstanding the above, we will maintain information on Users who have been removed for violating our Terms of Service.
